Naghain ng resolu¬syon ang limang senador na kabilang sa bagong ¬Senate minority group na humihiling kay Senador Ronald “Bato” dela Rosa na boluntaryong sumuko sa mga awtoridad matapos itong isyuhan ng warrant of arrest ng International Criminal Court (ICC).
Ang mga lumagda sa Senate Resolution No. 395 ay sina dating Senate ¬President Vicente “Tito” Sotto III, dating Senate president Pro Tempore Panfilo “Ping” Lacson, Sens. Risa Hontiveros, Paolo “Bam” Aquino IV, at Francis “Kiko” Pangilinan.
Punto ng limang senador sa resolusyon, iginagalang ng Senado ang “judicial and prosecutorial processes” na kinasasangkutan ng kanilang mga miyembro at da¬ting opisyal, katulad ng boluntaryong aksiyon at judicial submission kay dating Senador Juan Ponce Enrile, ang legal remedies at court proceedings kina dating senador at ngayon ay ML Party-list Rep. Leila De Lima at ang judicial course na isinagawa noon ni dating Senador Antonio Trillanes IV.
“Whereas, Article II, Section 1 of the 1987 ¬Constitution provides that ‘The Philippines is a democratic and republican State. Sovereignty resides in the people and all government authority emanates from them,’ thereby, requiring all public officials and institutions to remain accountable under the law,” sabi sa resolusyon.
Bagama’t may ibinibigay na legislative powers at institutional privileges sa Kongreso, nakasaad sa Article VI ng Konstitusyon na hindi pinahihintulutan ang Senado na magbigay ng “sanctuary, immunity from arrest, o tinatawag na “protective custody” sa sino mang miyembro na nahaharap sa kaso na hindi saklaw sa saligang batas.
Limitado lamang umano ang pagbibigay ng proteksiyon sa mga myembro ng Kongreso na nahaharap sa parusang hindi hihigit sa anim na taong pagkakakulong, ibig sabihin walang blanket authority o protective custody ang Senado sa mga myembro na nahaharap sa grave offenses o ma¬tinding paglabag sa batas.
“Now, therefore, be it resolved, as it is hereby resolved by the Senate of the Philippines, to urge Senator Ronald ‘Bato’ M. dela Rosa to voluntarily surrender to the proper authorities and seek judicial remedies in accordance with the Constitution and applicable laws and rules,” giit ng resolusyon.
