Ibinasura ng Office of the Ombudsman ang criminal at administrative complaints laban kina Executive Secretary Ralph Recto at dating Philippine Health Insurance Corp. (PhilHealth) President at CEO Emmanuel Ledesma Jr. dahil sa kawalan ng sapat na ebidensiya.
Sa 40-pahinang consolidated resolution na may petsang June 2, dinismis ng Ombudsman ang technical malversation, graft, at plunder complaints laban kina Recto at Ledesma, dahil sa kawalan ng prima facie evidence na may “reasonable certainty of conviction”.
Ang reklamong grave misconduct kay Recto ay binasura rin dahil sa kawalan ng ebidensiya, habang ang parehong reklamo kay Ledesma ay dinismis dahil sa kawalan ng hurisdiksiyon.
“This Office resolves to dismiss the criminal and administrative complaints against respondents for lack of prima facie evidence with reasonable certainty of conviction and insufficiency of evidence, respectively,” ayon sa resolusyon.
Nag-ugat ang reklamo sa paglipat ng P60 bilyong reserve fund ng PhilHealth patungo sa National Treasury noong nakaupo pa si Recto bilang Finance secretary.
Nauna nang naglabas ng desisyon ang Supreme Court na labag sa Konstitusyon ang paglilipat ng pondo pero isinoli na ito ng gobyerno sa PhilHealth.
